I wasn't a big fan of NFIB v. Sebelius either. Using the Commerce Clause to


justify forcing every individual to purchase a private product (in this case health insurance) for living in the US was fairly outrageous, as I've written on here before. Not engaging in a business transaction still has an impact on commerce and can thus be regulated? That's fairly tortuous logic. Sotomayor's attempt to compare it to car insurance being mandatory was pretty shallow (as people aren't forced to drive).

NFIB v. Seb. was more distressing imo, but it was well hashed out on here, and I knew it wouldn't move the needle for you from previous experience, so I skipped it for Kelo. But, I'm surprised you aren't more bothered by Kelo. An expansion of the state's power vs property rights. We're talking about a poor lady with no political power whose home was taken and entire life uprooted in service to a private project. To take a person's property for such nebulous promises from a developer as "jobs" strikes me as something at which most people would look askance. You don't see the issues with that? How often do politicians walk around promising "jobs, jobs, jobs" on the campaign trail? I personally think the gov must reach a far higher bar to justify that kind of use of power. Eminent Domain should be only be employed as a last resort, with all other options exhausted, and even then only if the public benefit is quite significant.

Those are really the only two that I found particularly egregious, but I don't follow the SCOTUS closely. I tend to think the 2nd Amendment has been twisted from its intent, so I don't fault the liberal block for trying to fix Heller.
