I would agree with you , but Hoomonger implied ...

that what happened AFTER the panel meeting is moot because it's a First Amendment case. It's more about possibly denying a person the right to challenge ideas civilly (from the recording).

I have no clue what can and what can't be taken as evidence in the First Amendment case. I would tend to agree with you, but Hoomonger appears pretty confident in his opinion.

Is the one case the court accepted a strict 1st amendment argument or how the suspended student was treated? It might be more about the right to be heard. I honestly don't know.
