A follow up story I’d be interested in is whether the Trump team sought to assert attorney-client privilege over this McDougal recording. If not, why not? As it’s described, they discussed the legal structure of a transaction. Or if so, on what basis was their claim denied?
If a Trump defense team claim of attorney-client privilege has been denied on the basis of the crime-fraud exception (e.g. if a judge agreed their discussion was intended to facilitate or cover up a campaign finance violation), that would obviously vault the story to a new plane.
Or, more likely, if the Special Master ruled that way and they didn’t even take it to the judge.
