He needed to be charged but the pressure is on the Prosecutor now


Speedy trial rule in Minnesota is 60 days from arraignment. I expect the defense attorney will push for a speedy arraignment and then hope that the District Attorney makes mistakes or key pieces of evidence aren’t back from the lab yet. The preliminary autopsy shouldn’t take that long but the toxicology always takes longer. The last thing a prosecutor wants is to go to trial without a final autopsy. It’s possible that they may use the State charge to hold the defendant in custody and then Nolle pros the State Charge and serve a Federal indictment. Speedy Trial rules apply in Federal Court too. The penalty for violating speedy trial rules include dismissal of all charges. So the choice may be go to trial unprepared or dismissal. Prosecutors don’t like either of those options. And I don’t think the protesters would understand either. The case against the other 3 officers looks more complicated, so there’s a good reason to do as much investigation as possible before starting their clock. I think all 3 need to be charged, but I see the value in getting it right.
