At least one of the state reps believes so. I'm copying and pasting from Mark Peake's facebook page (he made it public and I am referencing it, so I think I'm ok doing so). regardless of if you agree with Peake's personal politics, it makes sense to ME that more than just Northam should be weighing in on things...

It is amazing to me that every time the Governor holds a press conference, people are more confused than before he spoke. After every press conference, I get calls from my constituents wondering “what did he say and how does it affect me?"
The Governor’s school proposal outlines a period of continual uncertainty allowing him sole control over parents, educators, and local schools. The Governor, at his sole discretion, can determine when schools can return to normal. There are no set timelines by which our schools, parents, and students can organize their lives.
As my colleague, Sen. Petersen (D – Fairfax) says, “He’s using powers that are supposed to be for an emergency but, instead, he’s basically passing long-lasting and semi-permanent laws… [H]e is doing it without any legislative approval. And that is unconstitutional.”
Governor Northam, you were elected to lead, not to rule. It is way past time for you to call the General Assembly back into session so we can address issues vital to the functioning of the Commonwealth. It has been 90 days since you declared a state of emergency and it is time that the General Assembly, the people's representatives, have a say in the actions you are taking.
