I think. When they first tried to stop him he told them he had a right to go where he was going. Doesn't sound unreasonable. But then the officer told him he had a right to stop him because he was being suspicious. Then the officer grabbed him on the arm - the first physical contact between the two and it escalated quickly from there. The state code cited requires more than "being suspicious" for a stop. Where was the tie in to some criminal activity. That's where the prosecutors report seems very generous to the officers. So we can be stopped and physically restrained for wearing weather inappropriate clothing? Thats basically what they had to work with there.
