Note that if the full Circuit overrules the 3-judge panel, the case goes
back to the District Court for a hearing on the merits on that Motion to Dismiss. That's what was obviated by Flynn's mandamus writ. If the trial court grants the m to dismiss, it's all over; if the trial court denies the m to dismiss, I suppose Flynn take it up to the DC Circuit again; I don't think he has too wait to be sentenced and then appeal but I could be wrong about that.
