And terms of use agreements are actually a bit different from an insurance contract is that there’s no fixed contract period and they can be changed prospectively by the service provider at any time. So yes, Twitter can set AND CHANGE its terms of use as it sees fit. It can also freely suspend or ban users for violating its terms of use. That gives them pretty broad ability to do just about anything they want with their service. And you’re free to agree to their TOS and use their service… or not.

But you’re right, Twitter enforcing its terms of use or even modifying its terms of use, is just like an insurance company deciding to do “anything they want” with respect to an insurance claim. Again awesome analogy. The good news is the analogy resonated with hokiedan95 and he’s not a total fucking moron or anything.
