A bankruptcy court can follow bankruptcy


law if a verdict exceeds a defendant’s asset and the defendant files for bankruptcy protection.

I don’t think juries or judges consider a defendant’s ability to pay when it comes to compensatory damages, although I think they can for punitive damages. Maybe one of the board’s trial lawyers can weigh in.
