It's fine to disagree with hate crimes legislation, but that makes no sense

at all. A crime of passion is not a hate crime. An escalated fight or altercation is not a hate crime. Killing a witness to cover your tracks is not a hate crime. Drug-related turf wars aren't hate crimes. Contract killings aren't hate crimes. And so on down the line.

If there is a crime that should be considered a "hate crime" in nature, it's probably rape. Even there, a lot of grey area regarding motive.
