It's a good question, and can you impeach for an indiscretion that goes beyond the strict legal definition of the statute that was allegedly broken? "High crimes and misdemeanors such as treason". Impeachment has to precede conviction, so inherently it doesn't require that, and it isn't reversed if the fallen president is ultimately exhonerated. It's a political determination about fitness to serve.

A dem congress and senate would be on the march to impeachment right now IMO. And removal. But Pres hill, same Congress, same circumstances, same would be true. It's political, as the Constitution left it.

I think impeachment and removal have become more likely this week. Not sure how likely now, but likelier than two weeks ago.
