That's your conclusion. It wasn't law enforcement's conclusion.
"But for intent". The law says no intent, no crime. Thus, no evidence of a crime as concluded by the FBI.
So at best, you have evidence of elements of a crime that under the law did not add up to a crime, according to federal law enforcement interpretation of the law.
Even if there were further evidence of a crime, presumption of innocence makes the "lock her up" cries by Trumpies absurd.
Screams of "lock him up" about Trump wouldn't be any less absurd, sure. But as much as you are trying to split hairs here, it really wouldn't be any more absurd.
The staunch defenders of Trump to the bitter end, to the extent they were screaming "lock her up" about Hillary, are hypocrites of the highest order.
