It’s a state by state thing. But some charges are lesser included


And some aren’t. I’m not a Virginia lawyer or a criminal lawyer, but took a quick look and saw a case that said murder and manslaughter can be submitted together in Virginia.

Of course the prosecutor can decide only to submit one to avoid giving the jury the option of only going for the lesser one. But the defendant has the option of submitting the lesser one also - risking looking guilty of it though.
