“Precisely what the constitution does (is primarily) limit congressional authority”. Can I introduce you to my friend, Article I? Or the parts in Article II and Article III that give Congress a role in the other two branches? I know you are talking about specific provisions (mostly in the bill of rights) but come on.

But regardless, I am discussing economic rights mostly with some voting/democratic rights thrown in. Where in the Constituion are these rights restricted from Congressional control? Conservatives are trying to do so through the First Amendment, but this is a novel interpretation of recent years. It is not based in textualism, originalism, or precedent. It is conservative justices being activists...they are creating new law and taking the power away from Congress (the democratically accountable branch).

This is called the counter-majoritarian difficulty. When unelected justices overrule democratically elected legislators, this is an undemocratic action. There are obvious places where such action is justified because rights require it. But justices should be hesitant to do so.

There used to be a consensus that justices would let congress make decisions on economic regulations, and voting related regulation because such decisions should be as close to the people as possible. But the new conservative Supreme Court is changing this.
