Question about "off the record" and reporting such things


(trying not to get into discussion about the politics - just the pure journalism point of view)

President holds an "off the record" meeting. I assume attendees agree that it's off the record. However, one of the attendees passes information on to a media outlet, who then reports it. I'm also assuming that media outlet was not at the meeting, or else they'd have agreed to the off-the-record part.

NYT reported it, but I haven't seen anything definitively saying that they weren't at the meeting. I've seen it described as being with TV people.

Does said media outlet have any sort of obligation to keep it off the record since they weren't actually at the meeting and part of the agreement?
Is NYT saying anything along the lines of "we never agreed to keep it off the record. we only reported what we were told by someone that was there..."
