An interesting question is presented in the comment section
"Doesn’t she *actually need to be 13*. If a 30-year old tells you she’s 13, is it actually a crime to sleep with her, just because she *said* she’s 13? (I’m sure there are consenting adults who roleplay highschool teacher/student scenarios, i suppose they’re all actual pedophiles instead of consenting adults because one is pretending to be under age)."
So my question:
Say he actually went through with having sex with a 20-something who told him she was 13 ... has he actually committed a crime (assuming the sex were consensual)? If not, how do you arrest him for intending to commit a crime, that if he'd actually committed, wouldn't even be a crime?
