I specifically said that BvG did NOT involve an allegation of fraud, whereas the current election dispute does. Therefore, BvG would likely not apply to the current recounts in the context of any fraud (alleged/proven). The USSC in BvG did not say you have to stop recounts even if fraud were proven -- it stopped recounts because they were selective in nature in terms of both location and methodology, thus disenfranchising other voters. (In other words, the FL Supreme Court had allowed cherry-picking to occur with no justification provided.)

I'm making no comment here on the credibility of the current fraud allegations, and it should go without saying that any such allegation would need to be credible in the eyes of the court for it to take any action related to it. If one assumes, however, the fraud CAN be proven, then it's hard to imagine the USSC coming in to stop a recount designed to weed out that fraud, and it almost certainly wouldn't use BvG as pretext since that case did not involve fraud.

Again, I am speaking hypothetically about the fraud here for the sake of argument.
