happen or even be close IMO), that he would still have the option of taking it to court as unconstitutional (since he's already out of office), and that it by no means would be a slam dunk to get shot down, far from it according to that "constitutional scholar" (hoos name I can't remember, nor was it one I was familiar with).

With that said, I don't think he'll ever run again regardless. The only thing that could change that IMO is that he gets so pissed that they are trying this, and comes out looking like a martyr, that he runs again just as a giant F.U. to those going after him and those on the right he thinks are abandoning him.
