I imagine defense would appeal to judge

And argue why they believe the DA is violating the standards set by the Supreme Court. If they're denied then it's grounds for appeal after the trial. I guess you could change the standards for preemptive strikes too, but I'm guessing most courts just allow for arguments before trial and on appeal.
