Well, it seems like it is now perfectly acceptable

to approve SC justices during (and after) an election. If the Ds lose the Senate in '22, couldn't Breyer retire the day after the votes are counted and Schumer could hold a vote during a lame duck session? Had RBG passed between the election and the swearing in of a new Senate on Jan 3, you know Mitch would have held a vote on a Trump nominee. Or am I missing something here? Clearly Breyer would have to play ball... and Manchin.

Mitch took a lot of the guesswork and gamesmanship out of the process - we apply the letter of the law, we don't try to assert a "spirit". Biden rule is gone. McConnell rule (that he changed last year) is gone.
