I think it’s more to do with federal versus state powers…


Biden’s mandate was both logically unsound and a legal abuse of OSHA, but the Constitution also comes into play. He’s running into problems for all three reasons.

I think states and localities will have more leeway with the federal courts on the vax mandate question, and that seems to be how this has been playing out so far. I could see fed courts punting on a lot of these local cases, so if courts in, say, NY are stocked with lib judges, then who’s going to stop them?
