Opposed to any sort of criminal action against protests at justices’ homes, and believes any such effort would not survive judicial scrutiny.
He is sharply critical of Biden and Garland on the subject, although this was written prior to Garland’s order to ramp up protection of justices and their families, which appears to be all Turley would like to see.
Freedom of speech is under assault all over the country. College campuses to newspaper editorial pages to social media. I understand the gray in all this, but I think we are losing sight of the overarching importance of freedom of expression in this country. As we see in this thread, that is bipartisan. People tend only to support expression of ideas they support. That which they don’t, not so much.
I think those opposing legal action against protestors now should play a thought game - if a leaked opinion indicated an intent to change the interpretation of the 2A as protecting individual gun ownership, resulting in protests at left leaning justice residences, would your opinion about criminal action against protestors change?
Hopefully, the answer to that is “no”. I’m sure Turley disagrees with the protestors, but I lean towards his emphasis on freedom of expression, now more than ever.
