First you would want to start with installations where the Federal Government has exclusive jurisdiction. There are bases where there is concurrent jurisdiction with the State but this jurisdiction is generally specifically related to certain offenses like under age drinking by juveniles. Even if there is broad concurrent jurisdiction, the Federal Government prevails under the supremacy Clause of the Constitution (Article 6 cl 2) where the laws are in conflict. There would also need to be something in place at DOJ that prevents Federal prosecution for State offenses under the Assimilated Crimes Act (that’s the law that allows for Federal prosecution of offenses committed on Federal law where there is a violation of State law but not Federal Law). All of this relies on the Democrats retaining the White House.
