Well there certainly is the question now to distinguish between documents t

that he was provided as the President of the United States, and documents he obtained otherwise, if any of the latter.
Again just taking the documents and not sending them back is a violation of the federal records law regardless what kind of documents they were regardless of whether they were classified in any way. The violation gets worse depending on what the documents were, how they were obtained, and ultimately why he wanted to have them.
