Having the right charges can be crucial. I once defended a man

as defense counsel during my time in Vietnam. He was a private charged with sleeping while on guard duty. He was still on his feet in a sand bagged position with his rifle lying on a sand bag at side his, when a sergeant of the guard approached from the rear and picked up his rifle without getting any reaction.

I got an acquittal from the court. Had they included a lesser charge of not being attentive, he would have been convicted of that.
