Laughable post. First, comparing appointees from 30-40 years ago when


there was a Republican president but a strong Dem majority in the Senate to now ...when the GOP senate "Borked" an actual moderate and refused to even let a Dem president fill a vacancy...is a joke. You know Scalia, Kennedy, and Thomas were all confirmed while the Dems controlled the Senate, no?

Second, your characterization of the justices is just flat out ignorant. Kennedy and Roberts are only "center right" in a world where hard right is the whackiest federalist society nutjobs. Who soon will be nearly half the court. And Roberts isn't too far from them ideologically speaking. He just understands that he is in a leadership role, is a very, very sharp and politically savvy man, and knows better than to allow his court to be a complete joke. So he lets his colleagues come at things with the blunt instruments, but then pulls out his scalpel like he did with the ACA. I respect him -- heck, I downright admire the man because he's brilliant and professional as all heck. But a moderate "centrist" his is not.

Kennedy also is only called a "moderate" because he's not a culture warrior out to ban gay marriage and abortion. But he is a federalist society guy through and through on the rest. He wrote Citizens Fucking United for goodness sakes and voted to declare the ACA unconstitutional.

You also seem to miss that Breyer and Ginsburg were consensus candidates that were blessed by GOP leadership (Orrin Hatch in particular) and there is nothing remotely extreme about them or the two Obama appointees either (although by that time the GOP made clear anyone left of Attilla the Hun would never get their votes). Remind me again what extreme opinions Kagan, Sotomayor, Breyer, or heck, even Ginsburg have written? None are remotely out of the mainstream. In fact, their views are consistent with upwards of 70% of the country on most issues. Compare that to the court's right....where Roberts is now being called a "moderate." That apparently was also the flaw of O'Connor and Souter. They ended up being fair and intelligent instead of right wing nut jobs.
