Honestly, the fact that the challenge to the ACA even stood a snowball's

chance in hell with the SCOTUS shows how radically to the right it has shifted. The Commerce Clause, N&P clause, etc. were used broadly as a grant to Congress -- our elected representatives -- to legislate to their heart's content on national issues for a century before so-called "conservatives" started using it to strike down these laws as unconstitutional.

In legal circles, there was a level of disbelief that the arguments being made about the ACA got past the "go" stage. It only did because the Republicans have been so successful at grooming reactionary whackadoodles and then stacking the courts with them for the last 40 years.
