The court's size isn't set by the Constitution, nor should it be. Congress


has the power to change it if required. It hasn't happened since 1867, but that doesn't make the number 9 set in stone. In fact over the years prior to 1867 it was changed several times. I've even heard arguments that it should change anyway just because of circuit case load.

Bottom line is I wouldn't want that restriction in the Constitution particularly depending on how activist the court gets. Not that an amendment like that would pass anyway.
