We were taught in my concealed carry class, if the person is more than 7 feet away from you and you shoot them, you’re going to prison. Obviously there are a few extenuating circumstances in that, but the advice is solid. Distance means safety and an escape route. Not taking advantage of that negates self defense.

If the husband truly is 10 feet away and not charging then the homeowner doesn’t have a case. If on the other hand, the husband is coming back at the homeowner, then self defense will probably keep him out of jail. Even though he escalated the situation by getting a gun.

As an aside, it sounds like to me he used a .22 rifle. Not trying to side with the homeowner, but if true maybe he was just trying to scare the husband or think the .22 would only wound the husband if used.
