I agree with much harsher penalties for DUI, but in order to


accomplish this, I think we need different penalties for different levels of intoxication. Someone who has a 3rd glass of wine at dinner probably shouldn't be driving, but is probably no more dangerous than a distracted driver talking on the phone. And if you have a penalty as harsh as 6 months in jail, loss of license for 5 years and forfeiture of vehicle, it's going to be hard to get a jury to convict unless there is an accident with injuries or deaths.

I'd like to see something like 0.06 - 0.10 is a serious moving violation, major points on license, night in jail, hefty fines, potential suspension of license, and definite suspension of license for 2nd offense... basically treat it like a current DUI. Then if you are driving a 0.10 or more, we go with the RML level of punishment. At that level of intoxication, you have not business being behind the wheel, you are recklessly endangering the lives of people around you, and no one gets to a 0.10 level of intoxication by simply having a 3rd glass of wine with dinner instead of stopping with 2.
