Two second history of corporations: There used to be public corporations (towns) and private corporations (companies). They had the same rights. At some point these split, and public corporations and private corporations have very different rights.

My point is that corporate rights are entirely dependent on state law. I know this may sound surprising because state corporate law has not been used to police corporations in the modern era, but that is the intellectual and legal foundation of corporations.

Now I suppose its possible that a conservative Supreme Court would say that the current corporate structure is locked in. This would be a very activist corporate ruling. That is far from originalism or a textual answer. It would take these decisions outside of the democratic decision making process (which should be avoided) solely on the normative economic preferences of the Supreme Court. This may happen, but you should see it for what it is.
