Laugh now, but this is exactly the shit the Federalist Society and the

people who promote it have in mind. Perhaps not those specific things, but as the article points out, every single administrative law now comes into play to be adjudicated in the courts. Just how the hell is Congress qualified to deal with, in particular, technological problems where they have no expertise or that shouldn't be resolved in the political arena (as the article points out)? The negative consequences are enormous and it isn't just the Supreme Court that is affected. The Senate has fast-tracked 150 or so lower judicial appointments this year to insure that their powerful friends get friendly treatment at the expense of the rest of us.
