We're not going to agree on AA, so I'll avoid commenting further, other...
...than to ask why Justices would be "black-robed politicians" in this instance. Race-based favoritism is not a political issue, or at least not a partisan issue. Sure, politicians talk about it, but government-imposed racial preferences is a fundamentally Constitutional issue. The court should absolutely take it up.
As far as stare decisis goes, things change over time. Yes, the USSC should not be whipping decisions around every few years, but even if you believe that AA was warranted two generations ago, that doesn't mean it's warranted now. If 44 years isn't a legitimate expiration date, then what is?
