That's crazy, not just because Congress could not have foreseen back in 1970 what regulations may have made sense to implement, but also because other regulatory agencies have made similar decisions in the past to meet the objectives of the law. The Court may as well just have come out and said that the Clean Air Act is outdated, which it may be in other respects, but that is not for them to decide.

This is very similar to their ruling earlier in their term regard OSHA enforcement of vaccinations. It is naive to think that elimination of the Chevron deference is precisely where this Court intends to go, despite protestations to the contrary that this decision is limited. The impacts to the general public will be devastating. The benefactors will be a select few corporations and wealthy individuals who are seeing their investment in the Court now pay dividends.

But no, we are to believe that the Court is benignly calling balls and strikes, or simply returning "rights" to the states. Wow.
