It is a fascinating topic and still relevant.

A long time ago I read this in Shelby Foote and it has informed my thinking on the subject:

Despite the Chief Justice's opinion, given in private nine months ago, that no such accusation could be sustained, they fell back on a vague charge of "treason," and persisted in it even after the distinguished jurist Francis Lieber, handed all the War Department evidence to study for recommendations on procedure, told them flatly: "Davis will not be found guilty and we shall stand there completely beaten."

It seems that her conclusion is consistent with that. Imagine the implications of a ruling that secession was not illegal and therefore not treasonous, after 600,000+ deaths and a devastating war premised on the argument that it was.
