Nicoletti agrees with the allegation that Dana deliberately....

...misrepresented the unsettled state of the law regarding the legal status of the Confederacy in the textbook he edited.

"Dana did recast the tentative, makeshift legal maneuvers and theories that sustained the Union war effort as settled 'law'... In this he joined a number of pro-Union legal thinkers who wanted to manufacture certainty in the war's aftermath--and to whitewash any evidence that uncertainty ever existed. After the war's conclusion, the Unionists were the lawmakers--and the law's expositors--and they could erase the power the secessionist arguments once had." p. 251 (in a footnote she says "Francis Lieber and William Whiting were also engaged to do this.")
