Re: The popular vote if I were King for a day I'd do away with the Electoral College. Hell, I might even do away with the popular election of the President all together. Let us be a Parliamentary Republic where the House chooses the President.

As far as judicial appointments go that's they way the cookie crumbles. I agree it's obscene that a third of the SCOTUS was chosen by a game show host, but oh well.

And as far as party leadership and rules of order go. Well, most of that isn't actually in the Constitution anyway, and can be changed relatively easily if people wanted it to.

[edit] As to the subject line. We are not a Democracy. We are a Republic. There is no written-in-stone best way to divy up representation, so having half of the legislature determined based on mid-level governmental unit counts is as good as any other.
