I think it's a risk right now and always has been. The SCOTUS...


...apparently is taking up a case that might provide guidance on the matter, but my understanding is that a state legislature could theoretically submit its own electors for president right now, and Congress could vote to accept them if they wanted to. Who's going to stop them?

You might say, well, the courts would stop them, but who knows? Most courts in the 2020 election disputes -- including the Supreme Court -- refused even to hear cases. Why would this hypothetical situation necessarily be any different? We know for a fact that Congress has the power to vote to decline to accept electors, so what's the difference? A Republican majority in Congress could vote not to accept the Democrat-majority electoral votes from California, or a Dem Congressional majority could vote not to accept the Rep-majority votes from Texas.
