There actually was precedent—in 1852. Obama got “Fillmore’d”


That was the only example I could find where a SCOTUS nomination THAT far in advance of the end of a Presidential term was non-actioned by Congress.

I thought it was ridiculous that they allowed a Supreme Court vacancy to drag on for a year when they had a majority all along. Were they really that worried that half a dozen Senators would break ranks and confirm Obama’s nominee?

As you said, they’ll likely be paid back in kind for that stunt somewhere down the road. Might be way down the road though as vacancies in the final year have been quite rare.
