National Defense Act of 1916 was a key.


It created what was called a "dual oath" of service to the state (as before) but also to the federal government. The 1916 Act authorized the President to mobilize the National Guard in case of war or other national emergency, and for the duration of the event.

It was first evoked to patrol the Mexican border (Pancho Villa) and then in WWI by President Wilson. Many of German heritage resigned from the National Guard because of the dual oath.
