I think the Federal Civil Rights Act of 1964, which prohibits discrimination by privately owned places of public accommodation on the basis of race, color, religion or national origin probably refutes your statement by itself.
The right of public accommodation is also guaranteed to disabled citizens under the Americans with Disabilities Act, which prohibits discrimination by private businesses based on disability.
There's more recently been laws passed that prohibit discrimination for sexual orientation.
But yes, as an individual you can associate with whoever you see it, and ostracize those humans types you find to be lesser to yourself.
