Hearings for a lifetime appointment to what I consider the highest position in our government are not criminal trials, and no one has an “innocent until proven guilty” assumption or a due process right to be confirmed. If there are simply questions about the nominee’s character that X number of Senators are uncomfortable with, a no is perfectly appropriate. The process is inherently political and he could be denied confirmation simply because of his political views. He was certainly nominated because of them. And the point of these hearings is to thoroughly vet the candidate because, yes, the position is that important.
No one is saying Kavanaugh should lose his current job or go to jail for a sketchy 36 year old allegation. But he has no right to sit on the SCOTUS, and I would bet they could find another nominee who won’t be played by James Spader in a made for TV movie about his days as a purported rapey prep school alcoholic.
